When you contact a Connecticut licensed real estate salesperson or broker you must understand the ways they represent consumers.

 

Understanding Agency

 

  1. Seller's Representative (also known as a listing agent or seller's agent). A seller's agent is hired by and represents the seller. All fiduciary duties are owed to the seller. The agency relationship usually is created by a listing contract.

  2. Buyer's Representative (also known as buyer's agent). A real estate licensee who is hired by prospective buyers to represent them in a real estate transaction. The buyer's representative works in the buyers best interest throughout the transaction and owes fiduciary duties to the buyer. The buyer can pay the licensee directly through a negotiated fee, or the buyer's representative may be paid by the seller or by a commission split with the listing broker.

  3. Duel Agent. Dual agency is a relationship in which the brokerage firm represents both the buyer and seller in the same real estate transaction. Dual agency relationships do not carry with them all of the traditional fiduciary duties to clients. All parties in a dual agency transaction must give their written informed consent.

  4. Unrepresented Persons. A person(s) is unrepresented by a real estate agent unless he or she has signed a representation agreement with that agent.

Connecticut Law. Before a license attempts to negotiate a purchase, exchange, or lease of real estate on behalf of a prospective buyer or lessee, the licensee shall enter into an agency agreement with the party/parties for whom the license shall act. Connecticut Law regards a "showing" as an attempt to "negotiate". Therefore, prior to showing a property to a buyer, prior to putting that buyer into your car or meeting him/her at the property a license must have the buyer sign a Buyer Representation Agreement.
